In the vast majority of cases, when an employee is fired or let go from their job there is little, if anything, that they can do about it. The reason is that most people are 'at-will' employees and 'at-will' means that either the employee or the employer can end their relationship at any time for a good reason, a bad reason or no reason at all.

What an employer may not do is fire you in breach of an employment agreement, or for a reason that is a pretext for an illegal termination under state and federal employment laws.

If you have an employment contract or believe that your employer has fired you in retaliation for some action that you took (i.e., as a whistleblower) or in violation of state or federal law, you may have an action for damages or reinstatement to your position.

  • The Jury System Improvement Act of 1978, 28 U.S.C.A. § 1875 and the Protection of Employment of Petit and Grand Jurors, 42 Pa. Cons. Stat. Ann. § 4563, prevents termination for serving jury duty.
  • The Uniformed Services Employment and Reemployment Rights Act ("USERRA"), 38 U.S.C.A. §§ 4301-4333, prevents termination of military personnel for fulfilling military duties.
  • The Employee Retirement Income Security Act (ERISA) 42 U.S.C.A. 1001, et seq., prevents termination of employees to prevent benefits from vesting.
